On his first day back in office, Trump signed an order trying to kill birthright citizenship, the 157-year-old rule that says if you’re born here, you’re American, no asterisks.

Today the Supreme Court, the same one he stacked, told him no. The vote was 6-3, and five justices said the order straight up violates the 14th Amendment, the one written after the Civil War specifically so the government could never again decide who counts as a person.

This was already settled in 1898, when a man born in San Francisco to Chinese immigrant parents was ruled a citizen, end of story. Trump’s version would’ve denied citizenship to babies born to undocumented parents or temporary visitors, roughly 250,000 kids a year, born in the only country they’ll ever know, suddenly stateless on a technicality.

Three justices sided with him anyway.
